Section X. Smoking restrictions.

  1. Except as provided in Section Y, and in order to reduce the levels of exposure to environmental tobacco smoke, smoking shall be prohibited and no person shall smoke in an enclosed public place or workplace, including, but not limited to:
     
    1. Gaming facilities and any other facilities in which any gaming or gambling activity is conducted.

Delaware Clean Indoor Air Act, effective November 27, 2002

§ 2903. Smoking restrictions.

Except as is provided in § 2904 of this title, and in order to reduce the levels of exposure to environmental tobacco smoke, smoking shall not be permitted and no person shall smoke in any indoor enclosed area to which the general public is invited or in which the general public is permitted, including, but not limited to:

  1. Gaming facilities that are open to the public;

Colorado Clean Indoor Air Act – (Casino exemption repealed effective January 1, 2008)

25-14-204. General smoking restrictions.

  1. Except as provided in Section 25-14-205, and in order to reduce the levels of exposure to environmental tobacco smoke, smoking shall not be permitted and no person shall smoke in any indoor area, including, but not limited to:
     
    1. Limited gaming facilities and any other facilities in which any gaming or gambling activity is conducted;

25-14-205. Exceptions to smoking restrictions.

  1. This part 2 shall not apply to:
     
    1. The retail floor plan, as defined in section 12-47.1-509, C.R.S., of a licensed casino.

Louisiana Smokefree Air Act, effective January 1, 2007

  1. Nothing in this Part shall prohibit smoking in any of the following places:
     
    1. Designated smoking areas in which gaming operations are permitted to occur upon a riverboat, at the official gaming establishment, at a facility licensed for the operation of electronic video draw poker devices, at an eligible facility licensed for the operation of slot machines, by a licensed charitable organization, or at a pari-mutuel wagering facility or off-track wagering facility which is licensed for operation and regulated under the provisions of Chapters 4 and 11 of Title 4 and Chapters 4, 5, 6, and 7 of Title 27 of the Louisiana Revised Statutes of 1950, or any other gaming operations authorized by law, except that smoking shall be prohibited in all restaurants, including snack bars and any other type of eating area whether or not such area is separated from the gaming area, that are located within the facilities where gaming operations are conducted regardless of any type of license issued relevant to the operation of the restaurant.
